As property managers, it’s not uncommon to receive phone calls from a neighbour with a complaint that one of our tenants is creating problems. Neighbour Disputes become a source of distress and frustration. It is not uncommon for both sides of the dispute to have done things to annoy the other person.
In Western Australia, there is growing complaints about next-door neighbours. The Citizens Advice Bureau received over 5000 inquiries about neighbourhood disputes.
What Agent can do in cases of wrong behaviour by tenants?
We understand that disputes between neighbours can have a serious effect on everyday life. Unfortunately, if tenants are paying the rent then there isn't much the Property Manager can do. It is really a the police issue. The reality is, we aren’t responsible for the actions of our tenants. The fact is we are under no obligation to act simply because a complaint has been made.
When living in a rental property, tenants are obliged to not disturb the peace, comfort or privacy of their neighbours. In other words, the neighbours are entitled to quiet enjoyment of their property.
The first thing we always advise is usually to directly discuss the matter with the tenant in question. If this does not lead to a resolution, then you should proceed to make a complaint with the local Council or the Police.
What you can do?
♦ Stay calm and explain how the problem is affecting you
♦ Give your neighbour a chance to tell their side of the story
♦ Be prepared to listen …and let the other person know you are listening
♦ Try working on a resolution together
♦ Take time to work on a solution and get it right
